Below is a selection of examples of traffic injuries, where our clients have succeeded with their claims.
Rear-end collision
A young driver was rear-ended by a driver who had consumed alcohol. He suffered neck pain and was on sick leave for several weeks. After the accident, he had difficulty lifting heavy objects and had to change jobs, but has worked full-time since. A specialist assessed his injuries as 7% permanent medical disability. He was awarded NOK 400,000 in compensation, and the insurance company also covered all legal costs.
Head-on collision
A head-on collision in which the front-seat passenger sustained three spinal fractures. The fractures healed well, but compensation had previously been refused due to other health issues when we took over the case five years after the accident. The final result was 10% permanent medical disability and NOK 600,000 in compensation. Legal costs were covered in addition.
Compensation after motorcycle accident
A motorcyclist was travelling on a county/municipal road when a car turning left failed to notice the motorcycle and did not give way. The motorcyclist was seriously injured, suffering a head injury and other physical injuries. The total medical disability was eventually assessed at 71%. We submitted a compensation claim against the insurance company. As no agreement was reached, the company paid NOK 5,100,000. The case was brought before the courts, and the motorcyclist was ultimately awarded total compensation of NOK 7,500,000.
Changed solicitor after traffic accident
A traffic accident in 2006 resulted in head trauma and neck injury. The case remained with another law firm for nine years with little progress. The client was offered a final settlement of NOK 200,000, which he was dissatisfied with, and therefore changed solicitor to us. We negotiated the offer up to NOK 500,000, but rejected it as too low. We initiated legal proceedings, and following court mediation the case was settled with compensation of NOK 1,300,000. We handled the case for approximately one year, demonstrating the significant progress achieved compared to the previous representation.
Loss of income and expenses after motorcycle accident
A motorcyclist was seriously injured with multiple fractures and a head injury after a car driver failed to give way. We claimed compensation for loss of income up to settlement, future loss of income until age 67, future treatment costs, medical expenses, medication, rehabilitation, and home assistance. We also claimed lost pension rights, tax disadvantages, and non-economic damages. After negotiations, the compensation offer increased from NOK 1,850,000 to NOK 4,450,000.
Reduced deduction after moose collision
A driver collided with a moose that entered the roadway in an area clearly signposted for moose crossings and equipped with warning lights. Despite this, the driver failed to reduce speed. The insurance company argued for a 30% reduction in compensation. After negotiations, we succeeded in reducing the deduction by 15%.
Compensation and drink-driving
The Supreme Court delivered a judgment in 2014 concerning a driver under the influence of alcohol (1.66‰) who drove at 50–60 km/h without a seatbelt and was killed. The bereaved were subject to a 20% reduction in compensation.
Pedestrian hit – driver fled the scene
A pedestrian was struck and injured by a car whose driver fled the scene. After a prolonged pursuit, the police stopped and arrested the driver. It later emerged that the vehicle was uninsured. We assisted the injured pedestrian and contacted The Norwegian Motor Insurers’ Bureau (TFF). In cases involving uninsured or unidentified vehicles, TFF handles compensation on behalf of insurers. The pedestrian received full compensation for her financial loss.
Injured pedestrian forgot to note driver’s name
A woman was crossing at a pedestrian crossing when she was hit by a car. She suffered minor injuries and incurred a loss of income of approximately NOK 45,000. She spoke with the driver but forgot to note the driver’s name and phone number. TFF initially refused compensation, arguing this was her fault. We represented her, and after legal arguments and reference to case law, she received full compensation for her financial loss.
Car accident with low medical disability – reopening and compensation assessment
A person sustained a knee injury in a work-related traffic accident in 2000. The injury was assessed at 5% medical disability. In 2002, the insurance company settled the case for NOK 50,000 as full and final compensation. The injured party requested reopening in 2005 but was refused. We took over the case and concluded it in 2007 with an additional payment of NOK 2,250,000.
Full compensation after lorry accident
A lorry driver ran off the road and suffered severe injuries, including the amputation of an arm. The insurance company argued for a 30% reduction due to alleged failure to wear a seatbelt. We represented the driver, and the case concluded with full compensation, no deduction, and a total settlement of approximately NOK 2 million.
Whiplash: Driving instructor suffered neck injury
A driving instructor who was rear-ended suffered a neck injury and became 100% unable to work. The insurance company initially refused compensation. After the case was brought before the courts, it was settled through mediation, resulting in compensation exceeding NOK 1.8 million.
Whiplash: Rear-ended at work
A person was rear-ended at work and contacted us due to insufficient coverage of treatment expenses. She had not returned to work following the accident. Specialist assessments varied, but after we submitted a claim and negotiated with the insurer, the case was settled with compensation of NOK 955,000, corresponding to approximately 50% occupational disability.
Whiplash: Disabled after car accident
A man was involved in a car accident in 2008 and suffered a rear-end collision resulting in neck and head injuries. Medical disability was assessed at 19%, and he became 100% disabled due to the accident. The compensation case was concluded in 2014 with total compensation of approximately NOK 1,293,000.
Neck injury and work disability after moose collision
A man was involved in a collision with a moose and sustained a neck injury and headaches. Medical disability was assessed at 10–12%, and he became approximately 50% unable to work. We secured total compensation of NOK 2,193,000.
Neck injury and lower back pain after rear-end collision
A rear-end traffic accident caused neck injury and lower back pain. Initial compensation covered NOK 48,720 for loss of income and expenses, with an offer of NOK 15,000 for future loss. After specialist assessment arranged by us, permanent medical disability was set at 12%. The final compensation increased to NOK 1,500,000.
Concluding remarks
It should be noted that not all cases succeed, and in a small number of matters we are unable to adjust the compensation amount. As a general rule, however, we cautiously estimate that you will achieve between 50% and 100% higher compensation by using us compared to handling the case yourself with the insurance company. In other words, you will receive fairer compensation through our professional assistance.
In many traffic injury cases, it is clearly worthwhile to pursue legal proceedings against insurance companies. This is evident when comparing pre-litigation offers with final outcomes after legal proceedings. In our most recent cases, initial offers totalled NOK 4,411,000, while the final results after settlements or judgments amounted to NOK 11,500,000 – an increase of approximately NOK 7,100,000, or 160%.
