Compensation for non-economic loss (redress) is intended to compensate for the distress and suffering the injured party has been subjected to, for example in a traffic accident. If the driver responsible for the traffic accident acted with gross negligence or intent, you may be entitled to such compensation. Claims for non-economic damages can be submitted directly to the insurance company of the vehicle that caused the injury. If the police bring criminal proceedings against the responsible driver before the court, the claim for non-economic damages can be included as a separate claim within the criminal case. In such cases, it is advisable to obtain assistance from a victim’s legal representative to present the claim before the court.

Non-economic damages and compensation – victim’s legal representative
Several of our solicitors have experience acting as victim’s legal representatives in criminal cases. The representative is appointed by the court and is responsible for safeguarding the interests of the injured party and their next of kin during the investigation and court proceedings. The representative’s fees are covered by the public authorities without any means testing based on the injured party’s financial situation.
In connection with criminal proceedings, issues relating to compensation often arise. Based on our firm’s extensive expertise in personal injury compensation, we are well positioned to provide the best possible assistance in these matters.
The amount of non-economic damages varies from case to case, as the compensation must be assessed individually. In cases following traffic accidents where we have assisted with such claims, the compensation has ranged from NOK 25,000 to NOK 90,000.
