Driver of an articulated lorry collided with an oncoming passenger car – PTSD.
The driver of an articulated lorry collided with a passenger car that had crossed into the wrong lane. It was unclear whether the accident was caused by the driver of the car suffering a medical episode or whether it was a case of suicide. The lorry driver escaped relatively uninjured but developed psychological problems after the accident. He experienced nightmares, frequently thought about the accident, suffered flashbacks and was unable to return to his profession as a lorry driver. With our assistance, we succeeded in establishing that the insurance company was liable for both the accident and the resulting psychological injuries. Following negotiations with the insurer, our client was awarded a total of NOK 3,850,000 in compensation.
Lorry left the road – allegation of reduction due to not wearing a seatbelt
A lorry driver drove off the road and sustained serious injuries, including the amputation of one arm. The insurance company argued for a 30% reduction in compensation due to failure to wear a seatbelt. We were able to refute the insurer’s claim for reduction. The case resulted in full compensation and a total settlement of approximately NOK 2 million.
Driving instructor – rear-ended by a car
A driving instructor was rear-ended and suffered whiplash with subsequent neck pain, resulting in 100% incapacity for work. The insurance company refused to pay compensation. After we brought the case before the court, it was settled, and compensation exceeding NOK 1.8 million was paid.
Car collision – low degree of disability
A woman was rear-ended while at work. She contacted us because her expenses for treatment with a naprapath and physiotherapist were not fully covered by the insurance company. She had not returned to work after the accident. The specialist report concluded with 3% permanent medical disability and 5–10% occupational disability due to the injury. The specialist emphasised other causes such as previous neck pain and headaches. She had a history of sick leave due to head and neck pain prior to the accident. A specialist report in her social security case concluded with 15% permanent medical disability, but this report contained several fundamental errors. Before we became involved, the insurer had verbally rejected the claim, citing that the level of disability was too low. We submitted a claim and negotiated with the insurer, resulting in compensation of NOK 955,000. The compensation covered approximately 50% of her loss of earning capacity.
Car accident – disability
A man at work was involved in a car accident in 2008, resulting in neck pain, headaches and related symptoms. The specialist report concluded with 19% medical disability. He became 100% disabled as a result of the accident. The compensation case was concluded in 2014, and we secured approximately NOK 1,293,000 in compensation for our client.
