Injured on the way to work? Injured on the way home from work?

An injury sustained on the way to or from work is not necessarily the same as being injured at work. As a general rule, you are not considered to be working while travelling to or from work and are therefore not covered by occupational injury regulations. Normally, you must have arrived at your workplace for the injury to qualify as an occupational injury.

However, there are exceptions. If you started your day working from home, the journey may be considered a work-related trip, meaning the regulations may apply. Whether injuries during travel are covered depends on what is defined as your workplace. In some cases, your home may be considered a workplace, meaning you are covered from the moment you leave until you return home.

If travelling forms a significant part of your working day, for example when carrying out assignments or attending meetings far from home, you may also be covered under occupational injury regulations.

If you first attend your main workplace and then travel to one or more additional work locations to carry out tasks, deliver goods or similar duties, you will also normally be covered.

If your employer organises and pays for transportation, for example a taxi to work following an injury, you may also be covered. NAV may in some cases provide travel allowance. Read more about travel allowance here.

These situations can be difficult to assess. Feel free to contact us and we can help clarify your situation.

Remember that you may also be covered by other insurance policies while travelling to or from work, such as accident insurance or motor vehicle liability insurance in the event of a traffic accident. Read more about compensation following traffic accidents.

Workplace injury – who pays?

If you are injured at work, public authorities will normally cover your medical expenses and other treatment costs. You usually do not need to pay any deductible. Some employers also cover medical expenses following workplace injuries, although they are not legally required to do so.

You may also be entitled to have additional expenses covered by your employer’s insurance company. Read more here about what the occupational injury insurance covers.
