What is an occupational disease?

An occupational disease is an illness caused by your work. You may have been exposed to toxic substances, solvents, gas or smoke and developed lung diseases, COPD, lung cancer, etc. You may also have developed allergies or asthma through your work as a hairdresser, baker or construction worker. Many people who use vibrating tools develop vibration-related injuries. In some cases, you may have to leave your profession and find a new job, often through retraining. In other cases, you may become partially or fully disabled. It is important to know that we can help you obtain compensation for your loss of income when this happens. We also assist you within the NAV system so that you do not have to handle it on your own.

Not all illnesses are approved as occupational diseases.

Can I receive compensation for an occupational disease?

You may receive compensation for an occupational disease.

It is often a complex, demanding and time-consuming medical process to establish an occupational disease. The employer is obliged to report a workplace injury to NAV, and you are responsible for reporting the illness to your employer’s insurance company. The legal framework is complex and requires extensive discretionary assessments. You will therefore often need legal assistance to ensure that the correct evaluations are made. The lawyer you choose should have extensive experience in this field.

What does workplace injury insurance cover in cases of occupational disease? What are you entitled to?

If you have developed an occupational disease, you are entitled to compensation for all expenses and losses you have incurred and will incur as a result of the illness. Many people look for a calculator to estimate compensation, but since compensation must be assessed individually based on your circumstances, it is very difficult to create a simple calculator that provides an accurate result.

In the case of an occupational disease, you may be entitled to compensation for loss of income, future loss of income (general compensation), expenses, loss of household services, compensation for permanent injury and legal costs. Your loss of income, for example, depends on how much you would have earned without the illness and what you receive from NAV, your own insurance or your employer’s insurance outside the Workplace Injury Insurance Act.
